The Bathroom Wars: More Freedom Going Down the Toilet

Dear Bob,

I have a new article on the news and commentary website, “EpicTimes,” on, “The Bathroom Wars: More Freedom is Going Down the Toilet.”

Central to a free society is freedom of association, including in the marketplace. But this is once more under attack with the “bathroom wars” concerning accesses to toilets in the private sector by transgender individuals

Challenging freedoms of both private enterprises and the consuming public are those who wish to mandate either a transgender individual’s right to use the bathroom with the gender he/she identifies with, or to legally prohibit businesses from doing so by requiring the use of a bathroom identified with the individual’s biological sex.

Both are infringements with freedom of association and private business. This should be left to the free decisions of the owners and managers of businesses who are being responsive to the preferences of their customers and their employees in making market-oriented choices in these matters.

Instead, governments at the local and state levels wish to impose a “one-size-fits-all” compulsory mandate, rather than allowing the diversity of choices in these and related matters that market participants would likely settle upon, given the different values, preferences, and circumstances of individuals and groups in a complex society.

In the end, it is personal liberty, property rights, and freedom of association that will be the victim, once again, in this battle over bathrooms.
