A Libertarian On the Trump Judge Controversy

I have no idea whether the Mexican-American judge in the Trump University case is biased against Trump. I have seen some evidence that he may be, but I have not studied the facts in detail.

That said,Sheldon Richman is incorrect when he tweets out:

Richman is denying reality here. A judge may or may not be influenced by his heritage.

Does Richman really think that no judge has looked down upon other ethnic groups or races when making a ruling? Does he really think being American is to deny this reality?

I should add that in a Private Property Society this problem wouldn't necessarily arise. It is possible a PPS would result in "great and wise judges" emerging that all agree on in advance.  Or it is possible that on any specific case, both sides in a PPS dispute would have their respective  judicial representatives agree on a mutually acceptable judge.

Judge assignments would not necessarily be made randomly.

    I see. Well, as long as the judge happens to be of the "right" heritage, then everyhing will be hunky-dory. Why even mind the person's record? Why let things to chance?

  2. Isnt Trump essentially using the same "logic" that Sharpton and Jackson used decades ago? (IE a white judge can't judge a black man)

  3. A judge may or may not be influenced by his or her heritage. He or she may not be influenced by family situations, or his or her love for dogs or cats. He or she may or may not be influenced by current events. One TRUSTS that the judge will rely on an objective ponderance of the evidence, any testimony, and rule according to the law.

    The point is that El Trumpo cannot read minds. I can't, either, and I am sure you can't, Robert. The problem is with assuming a judge's decisions against YOUR interests are stemming from a heritage-derived animus against you. It may or may not be 'unamerican' to think so, but it is certainly not rational.

  4. For some odd reason, the establishment has pulled out all its guns the past few weeks in an effort to demolish Trump's presidential ambitions. I'm not a Trump supporter, but it's impossible not to notice. I remember earlier in the campaign finding it odd that Joe Scarborough and Zbigniew Brzezinski's daughter seemed so supportive of Trump on Morning Joe, but just yesterday Trump was called a racist by both hosts and even compared to Nazis. Even many of the establishment Republicans who previously supported Trump have been piling on.

      Maybe it is because El Trumpo's accusations against this judge are completely insane, inane and indefensible. What El Trumpo has been doing is basically question the judge's moral character based entirely on who his parents were from. And he's not the only one doing this. If you read Lew Rockwell's blog "Political Theater', he links to a piece that insinuates judge Gonzalo Curiel was an 'anchor baby'.
