No New Trial for Ross Ulbricht, Judge Rules

The judge who never ruled in Ross Ulbricht's favor on any significant defense objection during his trial, didn't change her tune during a  post-trialruling.

Judge Katherine B. Forrest, who presided over the Silk Road trial, denied Ulbricht’s motion for a new trial, writing in her 25-page opinion, “The evidence of Ulbricht’s guilt was, in all respects, overwhelming.”

The opinion comes on the heels of revelations of pervasive law enforcement misconduct during the Silk Road investigation, including the arrest of a secret service agent and a DEA agent for among other charges, theft of bitcoins and money laundering. Both agents conducted their alleged crimes while investigating Ubricht and, indeed, allegedly engaged in communication with Ulbricht to cause to act in an illegal manner, blackmail him and steal from him.

In her opinion, though, Forrest wrote, “[T]here is no basis for this Court to believe that any undisclosed materials relating to the Rogue Agents would have been remotely useful, let alone exculpatory."

Sentencing is scheduled for May 15. The defense has asked that the sentencing date be pushed back.
