Trump Goes After Immigrants Who Thought They Were Safe

Nick Miroff and Maria Sacchetti write:
A week after he won the election, President Trump promised that his administration would round up millions of immigrant gang members and drug dealers. And after he took office, arrests by Immigration and Customs Enforcement officers surged 40 percent.

Officials at the agency commonly known as ICE praise Trump for putting teeth back into immigration enforcement, and they say their agency continues to prioritize national security threats and violent criminals, much as the Obama administration did.

But as ICE officers get wider latitude to determine whom they detain, the biggest jump in arrests has been of immigrants with no criminal convictions. The agency made 37,734 “noncriminal” arrests in the government’s 2017 fiscal year, more than twice the number in the previous year. The category includes suspects facing possible charges as well as those without criminal records.

Critics say ICE is increasingly grabbing at the lowest-hanging fruit of deportation-eligible immigrants to meet the president’s unrealistic goals, replacing a targeted system with a scattershot approach aimed at boosting the agency’s enforcement statistics...

A Virginia mother was sent back to El Salvador in June after her 11 years in the United States unraveled because of a traffic stop. A Connecticut man with an American-born wife and children and no criminal record was deported to Guatemala last week. And an immigration activist in New York, Ravi Ragbir, was detained in January in a case that brought ICE a scathing rebuke from a federal judge.

“It ought not to be — and it has never before been — that those who have lived without incident in this country for years are subjected to treatment we associate with regimes we revile as unjust,” said U.S. District Judge Katherine B. Forrest, reading her opinion in court before ordering ICE to release Ragbir.

“We are not that country,” she said.

Immigrants whose only crime was living in the country illegally were largely left alone during the latter years of the Obama administration. But that policy has been scrapped.
Trump is an asshole and a very dangerous statist. Old school conservatives and libertarians who support Trump are going to eventually regret it.

This is awesomely great news! Libertardians who do not support this policy are the new assholes these days.

They need to leave and pay the fee to do it legally. Even though legal immigration needs to be seriously curtailed.

Which, coincidentally, are the ones who elicit the most feelings of envy among the mediocrities who placed Trump in power. ICE is deporting doctors, teachers, technology experts...

... So much for MS-13 being the focus of his immigration enforcement efforts.

    1. Are you smoking crack? Do you really think there are doctors practicing in the US who are illegal immigrants? If there are, they are also falsifying who they are, what their credentials are, etc. So I would damned well hope they are getting deported or worse.

But they will be subjected to treatment not unlike the treatment that reviled regimes inflict on equally innocent people, because that is what most Trumpistas voted for: an oppressive regime that wastes precious and scarce resources to go against their neighbours and other members of the community whose only fault is not having the government-issued transit papers, because "them immigruntz takum er jebz!".

─ Wenzel is clearly for open borders ─

He has stated before that he's not but, question is, why aren't you for open borders──open to trade, to the free flow of goods, services, capital and, yes, labor, without undue hindrance from that criminal enterprise people keep calling "The State"? What makes you think that there's legitimacy in imposing someone else's will between the voluntary and peaceful transaction between a native-born individual and a foreign-born individual?

    1. Yes there are productive illegal immigrants who contribute to the economy and pay their taxes, but as a net, illegal aliens are a net drain on government and tax resources. So be for open borders if you want to be, but don't make the taxpayers pay for it.

It wouldn't. All welfare states, including Israel, are doomed to fail. Israel's fantasy that it can forever steal land from property owners without political or financial retribution is certain to fail, as well. Israel would be better off with a larger workforce and eschewing its Marxist tendencies.

  5. ─ “What are we supposed to do?” said Matthew Albence, the top official in [ICE] immigration enforcement division, who described the administration’s goal as simply restoring the rule of law. If ICE fails to uphold its duties to enforce immigration laws, he added, “then the system has no integrity.” ─

Authoritarians don't shy away from hiding behind the "Rule of Law" parapet to justify their violations of people's peaceful and voluntary actions, without giving even a modicum of reflection on what Rule of Law means or entails.

─ At first glance, Albence said, many of ICE’s arrests may seem like “sympathetic cases ──individuals who are here, and who have been here a long time[...][but] the reason they’ve been here a long time is because they gamed the system,” he said. ─

It does not occur to the ICE "top official" that the reason many such immigrants 'game the system' is because their opportunity cost is driven higher and higher by tougher requirements and increasingly arcane rules that turns any chance of legalization into a forlorn hope. Better t take your chances and keep your head low rather than appearing in court with a big "Here I Am!" sign on your back.

─ “By crowding the courts with all kinds of people, you’re creating a resource problem,” [former policy adviser to Obama Cecilia] Muñoz said. “If you apply that logic to local police forces, you’re saying that every robber and rapist is the same as a jaywalker. And then you’re clogging your courts with jaywalkers.” ─

But that's where the crux of the matter lies: for anti-immigration hawks, undocumented immigrants and "border-jumpers" are criminals that should not be differentiated with murderers and rapists. As far as they're concerned, that is what they are, echoing what Trump said during his candidacy announcement speech.

Trumpistas were never libertarians. Not even the cafeteria kind. They were concerned with government encroachment in their lives only while Barry I "The Handsome" was in power, but not today that we have Donald I "The Orange Rind".

An illegal act carries consequences. Someone decided to break the law whether you or your parents. the longer you propagate the lie without becoming a citizen the more guilty you are.

Its these people that see no value in becoming a member of this sovereign all the while sending money out of the country to benefit those abroad. Seems like a shitty attitude to me let repercussions fall as they may.

It really is funny to me, that people get so bent out of shape over immigrants getting welfare and all this “free taxpayer money” and demand the State, who is the entity actually giving the welfare, to deport them. No one is holding a gun to the State to give the welfare. The State holds a gun on me to extort my labor to give it not only to immigrants, but foreign governments.
Why the irony isn’t more obvious is beyond me.
The immigration problem is the State.

  10. I’ve been reading St George Tucker’s commentary on the constitution, along with his commentary on the Bill of Rights, and his take down of the Adams administration’s alien and sedition’s act is amazing.
In this first commentary written on the Constitution, and specifically the 4th amendment, he points out that our founding documents don’t refer to “citizens” being afforded protections in the Bill of Rights, but to all “persons”. I think he was referring to that odd phrase, “ all men are created equal, and endowed by their Creator with certain unalienable Rights”...
His claim was (oddly enough) that all men, not just US citizens, obviously, because that status came later, have by their humanity the Rights put to paper in the Bill of Rights.
But what did those old dead white men know...

    3. That’s a pretty open ended question. Does a Somali have the right to engage with free exchange with a person in Minnesota who freely engages with him? Does the Minnesotan have the right to engage with the Somali?
The Bill of Rights tells us what the proper relationship between a person and the US government is, or should be. Is a Samoli a person? I guess this discussion depends on your thought to that question.
